MyWealthJunction (including Website are owned by Wealth Junction Consultants Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office at No: 46/47, C S Towers, 2nd Floor, Thimmaiah Road, 1st Stage, 5th Phase, WOC Road, Shivanagar, Rajajinagar, Bengaluru - 560044 and is also registered with the Securities and Exchange Board of India (‘SEBI’) as an Investment Adviser under SEBI (Investment Advisers) Regulations, 2013 (‘IA Regulations’) vide registration INA200011480), MyWealthJunction is in the business of providing Financial Planning, investment and wealth management services to users through its technology platforms.

Wealth Junction Consultants Private Limited is registered with BSE StAR MF vide Member ID: 23783 under SEBI Registered Investment Advisor Category for Mutual Fund Direct Plans and shall not receive any commissions from Asset Management Companies/Mutual Fund Houses.

These Terms and Conditions contain important information regarding the Services that MyWealthJunction provides.

Definitions

‘Client’or ‘Customer’ or ‘You’ means a person who is a registered user of www.mywealthjunction.com who has purchased an annual subscription of financial planning or avail any paid services at mywealthjunction.com

‘Data’ means information related to client feeding by client or information processed by software or information created by a team of www.mywealthjunction.com

‘Document Locker’ means dedicated cloud technology platform space provided by MyWealthJunction to the client to store, view, retrieve, download, modify, delete various information, data including soft-copy documents, video files, audio files and such other files

‘Financial Year’ means a period of accounting year commencing on 1st April and ending on 31st March every year

‘Financial Planning Software’ means proprietary technology tool products developed by www.mywealthjunction.com for use of clients for its financial planning subscription

‘My eWill’ means a Will drafting technology tool

MyWealthJunction’ or ‘Company’ or ‘Us’ or ‘We’ or ‘Our’ means the website www.mywealthjunction.com or Wealth Junction Consultants Private Limited ‘Services’ means subscription-based paid services provided by Wealth Junction Consultants Private Limited to its clients via website www.mywealthjunction.com related to financial planning, financial advice or such other online or offline paid services

These policies and documents are part of your acceptance of our services and it is binding on both parties as legal contract.

You have created your registration to avail Services and accepted all terms and policies. You may not use ‘Services’ if you do not accept any terms at these policies. You should be of legal age to enter into a contract.

Scope of Services

The annual subscription products offered at www.mywealthjunction.com and subscribed by the client shall be for a prescribed period as per subscription terms and use of subscription after expiry is illegal. www.mywealthjunction.com shall not be obliged to any client or any third party about data on expiry of subscription where renewal is not processed by the client.

MyWealthJunction is providing technology-based services to its clients and MyWealthJunction is constantly innovating its products and platform to provide the best possible user experience and accurate solutions. As a part of continuing innovation, you allow us to improve, modify, change, delete, hide, stop etc. various technology features to Financial Planning Software in the best interest of clients or as part of best business practices without any prior notice to you.

MyWealthJunction reserves rights to make changes to offers and prices without any prior notice or consent of Clients.

Our investment platform for mutual fund direct plans facilitates to execute and manage the customized financial plan through the proprietary platform. This would capture KYC information of Client and relevant information to track the performance of the Client’s financial plan.

You agree to use the Services for personal use as per Terms & Condition and within the application framework of laws, regulations and generally accepted practices in India.

You agree that you will not engage in any activity against the interest of the Company or its clients or laws of any country. You will not misuse your client rights in any manner. You agree that you will not use Services for any other person or you will not reproduce, duplicate, copy, sell, trade or resell the Services of Company in any manner.

You agree and understand that log-in and password details are confidential use for yourself only if you disclose to any other person you may be at risk of disclosure or loss confidentiality about your financial information at MyWealthJunction. If you become aware of any unauthorized use of your subscription or your password, you agree to change the password and also notify us of such illegal events.

You are aware that our Services is fully depended upon data and information which you have provided us as per simple questions to calculate, analyse, prepare reports/advice notes to you, hence, in the event of incorrect or hypothetical data entered by you we may not be held responsible for any loss or adverse stress etc. due to incorrect judgements at our end relating to financial planning advises to you.

You hereby authorize MyWealthJunction to share with Mutual Fund, AMC, RTAs and the Trustees, my signature available on the records of the KYC Registration Agency (“KRA”) or CKYC for authenticating and processing my requests.

You hereby agree, acknowledge and provide your consent that the information provided by you may be shared by MyWealthJunction with regulators/government bodies as and when required or requested by them.

You understand and agree to record your telephonic conversations with our customer support department (managed by itself or through any outsourced vendor) for quality control, record retention purposes, and other similar purposes, however, we agree to keep such records confidential.

You hereby give his/her consent to share/provide the transactions data feed/portfolio holdings/NAV etc. in respect of my investments under the Direct plan of all schemes to MyWealthJunction (SEBI registered investment advisor).

Your requests made for the purchase of any mutual fund scheme shall be processed by the respective mutual funds only after funds sufficient to cover the purchase price and other costs and charges have been received by the respective mutual funds from you. Payments towards the purchase price and other costs and charges shall be made by you through the payment gateway or other electronic means. You shall ensure that payments for the purchase of mutual fund shall be made through your own Bank account and in case of a joint Bank Account you shall be one of the holders of such Bank Account and should also be authorized by the other Bank Account holder for making such purchase. All payments should be through the legitimate source and should comply with the policies and guidelines laid down by RBI, NPCI, SEBI, or any other regulatory body. I am aware that if any investment is made through any third party Account then the same is liable to be rejected by MyWealthJunction or the AMC.

Your make investment at MyWealthJunction platform, the investment amount goes directly to the Mutual fund basis your selection. At no time, MyWealthJunction receives the investment amount. MyWealthJunction does not have any role to play in the investments that a Mutual fund makes in the market. Upon making such an investment, you enter into a bilateral contract with the Mutual fund House or AMC. You understand that mutual fund investments are subject to market risk. You should read all Offer Documents including the Scheme Information Document, Key Information Memorandum and Addenda for all the mutual fund schemes that you invest. By Investing in a Mutual Fund Scheme, it is deemed that you have read the offer document and are comfortable with the terms laid down in such offer document.

Upon your investment, units are allocated by Mutual funds as per applicable NAV, which is not under the control of MyWealthJunction. MyWealthJunction does not warrant that the calculation of NAV and units allotted by Mutual funds are correct. In case you notice any discrepancy, MyWealthJunction customer support team shall help you resolve the query through AMC.

You confirm that for investments in any units of the scheme you shall read and understood the content of the Scheme Information Documents / Statement of Additional Information of the scheme. You shall also read and understand the terms, conditions, details, rules and regulations governing the scheme.

MyWealthJunctionMutual Fund Investment platform can be activated for KYC Registration Agency (KRA) verified investors only. Accordingly while enrolling for the MyWealthJunction registration, your KRA verification process will be checked and you shall provide a copy of valid PAN and proof of completion KYC through SEBI approved KYC Registration Agency (KRA Agency) or other details as may be prescribed from time to time and these details shall get verified with KRA.

It is mandatory for you to create a Nomination for your account/holdings and no new folios/accounts for individuals in single holding shall be opened without nomination. However, in case investors do not wish to nominate must sign separately confirming their non-intention to nominate, failing which the form may be rejected at the discretion of the AMC/Mutual Fund. Products and Service Delivery Terms
Free Subscription Product

Free subscription services are for test and trial for clients and the Company shall not be responsible to free user, a registered user or any third party in any manner for use of such free services.

Payment Terms

The client has the option to pay the Subscription Charges for Basic, Standard & Advanced Plan as below

  1. Yearly
  2. Monthly (This facility is available only when paid through Credit Card. In case Monthly option selected. The client needs to give Standing Instruction to debit his/her Credit Card month on month.)

Basic Plan
  1. Clients who have subscribed and paid for Basic Plan should be KYC compliant at MyWealthJunction.
  2. This subscription is valid for one year from the date of payment. During subscription, the client has to provide the required information and details related to total wealth, assets and liabilities income and expenses, investments, insurance, life goals etc. at MyWealthJunction’s software
  3. We shall assimilate and analyse all information of client related to current financial health, goals, insurance, risk, investments and taxes to provide complete comprehensive financial plan with in-depth analysis related to goals, tax saving, insurance coverage, improve surplus, investment portfolio review and provide recommendations for actions to be taken by Client which in view of MyWealthJunction are in best interest of client.
  4. Client shall be eligible to interact with Financial Experts once reports are generated via phone call, email or such other medium to understand suggested advises and answer your queries.
  5. Client shall be eligible for review of portfolio and risk profile once every six months by a financial planner. For additional review, MyWealthJunction shall charge an additional Rs. 250/- + taxes as applicable per review.
  6. Client shall also get an opportunity to interact with Financial Expert twice a year by appointment scheduling via email or over a call.
  7. Client shall be eligible to invest in Mutual Fund Direct plans with zero commission for distribution.
  8. Free eWill is applicable only in Standard and Advanced Plan. However, you can buy it as an additional product with the Basic Plan.
  9. Client shall be eligible to get DIY Tax filing facility without any extra cost through our associate and reputed tax services company viz. ClearTax. Any advice or customized services shall be provided at an additional extra cost as per pricing of ClearTax.
  10. Client shall be eligible to get cloud-based Document Locker with 10 MB capacity to store all digital files, videos, audio etc.
  11. Report without customization is prepared by software hence the same could be read as broad guidance note. The report and recommendations provided by MyWealthJunction are as per assumptions and projections of MyWealthJunction experience and not to be treated as only ways since there could be many other such ways. This is to be treated as general guidance.
  12. Subscriptions availed by Client include software-based analysis of data inputs and also efforts of Financial Planners. MyWealthJunction does not take any responsibility for Client’s report which has incorrect information or details.
Standard Plan
  1. Clients who have subscribed and paid for Standard Plan should be KYC compliant at MyWealthJunction.
  2. This subscription is valid for one year from the date of payment. During subscription, the client has to provide the required information and details related to total wealth, assets and liabilities, income and expenses, investments, insurance, life goals etc. at MyWealthJunction’s software.
  3. We shall assimilate and analyse all information of client related to current financial health, goals, insurance, risk, investments and taxes to provide complete comprehensive financial plan with in-depth analysis related to goals, tax saving, insurance coverage, improve surplus, investment portfolio review and provide recommendations for actions to be taken by Client which in view of MyWealthJunction.is in best interest of client.
  4. Client shall be eligible to interact with Financial Experts once reports are generated via phone call, email or such other medium to understand suggested advises and answer your queries.
  5. Client shall be eligible for review of portfolio and risk profile once every six months by a financial planner.
  6. The client shall also get an opportunity to interact with Financial Experts flexibly all over the year.
  7. Client shall be eligible to invest in Mutual Fund Direct plans with zero commission for distribution.
  8. Client shall be eligible to draft one online Express Will worth Rs. 1,500/- without any extra cost for the first year of subscription to be used within 60 days of payment through our associate and reputed succession services portal viz. My eWill/Willjini.com. Any other services shall be charged as additional as per pricing of My eWill/ Willjini.com.
  9. Client shall be eligible to get DIY Tax filing facility without any extra cost through our associate and reputed tax services company viz. ClearTax. Any advice or customized services shall be provided at an additional extra cost as per pricing of ClearTax.
  10. Client shall be eligible to get cloud-based Document Locker with 10 MB capacity to store all digital files, videos, audio etc.
  11. Report without customization is prepared by software hence the same could be read as broad guidance note. The report and recommendations provided by MyWealthJunction. are as per assumptions and projections of MyWealthJunction. experience and not to be treated as only ways since there could be many other such ways. Advanced Plan
  1. Clients who have subscribed and paid for advance Plan should be KYC compliant at MyWealthJunction.
  2. This subscription is valid for one year from the date of payment. During subscription, the client has to provide the required information and details related to total wealth, assets and liabilities, income and expenses, investments, insurance, life goals etc. at MyWealthJunction’s software
  3. We shall assimilate and analyse all information of client related to current financial health, goals, insurance, risk, investments and taxes to provide complete comprehensive financial plan with in-depth analysis related to goals, tax saving, insurance coverage, improve surplus, investment portfolio review and provide recommendations for actions to be taken by Client which in view of MyWealthJunction is in best interest of client.
  4. Client shall be eligible to interact with Financial Experts once reports are generated via phone call, email or such other medium to understand suggested advises and answer your queries.
  5. Client shall be eligible for review of portfolio and risk profile once every three months by a financial planner.
  6. Client shall also get an opportunity to interact with Financial Expert unlimited time in a year.
  7. Client shall get Priority services at MyWealthJunction.
  8. Client shall be eligible to invest in Mutual Fund Direct plans with zero commission for distribution.
  9. Client shall be eligible to draft one online Standard Will worth Rs. 4,000/= without any extra cost for the first year of subscription to be used within 60 days of payment through our associate and reputed succession services portal viz. My eWill/Willjini.com. Any other services shall be charged as additional as per pricing of My eWill/ Willjini.com.
  10. Client shall be eligible to get DIY Tax filing facility without any extra cost through our associate and reputed tax services company viz. ClearTax. Any advice or customized services shall be provided at an additional extra cost as per pricing of ClearTax.
  11. Client shall be eligible to get cloud-based Document Locker with 10 MB capacity to store all digital files, videos, audio etc.

T&C for FinXpert E-Card
  • The FinXpert E-Card can be redeemed only at www.mywealthjunction.com
  • The FinXpert card balance cannot be exchanged for cash and credit points or redeemed against the purchase of another card.
  • This card is valid for a period of 12 months from the date of issue and cannot be revalidated.
  • The E-Card cannot be returned once purchased.
  • Partial redemption of E-card is not allowed.
  • MyWealthJunction is not responsible if the E-Card is lost, stolen or used without permission.
  • MyWealthJunction shall not be liable and responsible for any unauthorized and/or fraudulent purchase/s made using this E-Card.
  • No duplicate E-Card will be issued. E-Card is property of MyWealthJunction to whom it should be returned on request.
  • MyWealthJunction reserves the right to update and change the terms and condition of the FinXpert cards at any time.

T&C for FinXpert Physical Card
  • The FinXpert Physical Card can be redeemed only at www.mywealthjunction.com
  • The FinXpert card balance cannot be exchanged for cash and credit points or redeemed against the purchase of another card.
  • This card is valid for a period of 12 months from the date of issue and cannot be revalidated.
  • Your order placed for FinXpert Physical Card will be processed and delivered within 5-7 working days.
  • The Physical Card cannot be returned once purchased.
  • Partial redemption of Physical Card is not allowed.
  • In case of a damaged Physical Card, a new Card will be issued to the end customer, at brand’s discretions.
  • MyWealthJunction is not responsible if the card is lost, stolen or used without permission.
  • MyWealthJunction shall not be liable and responsible for any unauthorized and/or fraudulent purchase/s made using this Physical Card.
  • The holder of this Physical Card shall be solely responsible for the safe custody of the Physical Card and the credentials mentioned on it.
  • No duplicate Physical Card will be issued. Physical Card is the property of MyWealthJunction to whom it should be returned on request.
  • MyWealthJunction reserves the right to update and change the terms and condition of the FinXpert cards at any time.

FinXpert E-Card and Physical Card Redemption
  • Visit www.mywealthjunction.comand create an account.
  • Log In to your MyWealthJunction Account.
  • Click on the ‘Redeem Now’ on the Dashboard.
  • Select the plan as presented in the FinXpert Card.
  • Enter address and other required details followed by the Card Number and PIN.
  • The card value will contribute to your yearly subscription onMyWealthJunction DIY platform and you will be ready to roll!
T&C for Online Systematic Investment Plans (SIP) through mandate/NACH/ECS Mandate

 You understand and acknowledge that there could be a minimum time gap of at least 19 days from the date of submission of the physical (or fiscal) mandate, to enable the activation/registration of online SIP facility, subject to the successful validation of the mandate by the Banks. Likewise, there shall be a minimum gap of least 30 days from the date of receipt of SIP deactivation mandate and last investment made under SIP.

 Upon successful registration of mandate, you can start the online SIP facility for investing in mutual funds a fixed amount of money at a fixed frequency of time based on your convenience and choice.

 You grant Authority to MyWealthJunction its authorized payment processing service provider (third-party service provider) to debit your registered Bank Account through National Payments Corporation of India’s NACH (National Automated Clearing House) to enable the collection of the SIP instalments and transferring to the respective AMC’ s bank account. The conditions related to NACH are applicable as and when such a facility is made available.

You agree and acknowledge that to enable you to get the NAV on the SIP date (T date) chosen by you, a debit of the SIP amount from your Bank Account shall happen few days before the SIP date (T). e.g. T-2, T-4 etc., depending upon the NACH debit cycle of your Bank, which could vary from location to location, as per the NACH mechanism. You understand and acknowledge that MyWealthJunction its third-party service provider shall do a backward calculation from T date and depending upon NACH debit cycle, your account will be debited on T - no. of days, such that on T date (SIP day), the funds reach the respective AMC’s Bank account and the transaction data reach the respective registrar of AMC, to enable them to allot units as per NAV on T date.

 You agree and shall ensure to keep sufficient funds available in your Bank account at least 7 days before the SIP date (T date). You understand and acknowledge that SIP instalment and allotment of units shall be subject to realization of funds. You shall not hold MyWealthJunction or its third party Service Provider liable, in case the SIP instalment process could not be completed due to insufficient funds in Your Bank account on any particular NACH debit cycle date i.e. on T - no. of days. In such case, the SIP instalment shall lapse for that T of the month/quarter/half-year/year as the case may be.

  You can view the units allotted by AMC/registrar on the next day of SIP date (i.e. SIP day + 1 working day).

Online Payment Policy

This online payment system is provided by MyWealthJunction. MyWealthJunction may update these terms from time to time and any changes will be effective immediately on being set out here. Please ensure you are aware of the current terms. The country of domicile for MyWealthJunction is India.

Terms & Conditions

Please read these terms carefully before using the online payment facility. Using the online payment facility on this website indicates that you accept these terms. If you do not accept these terms do not use this facility.

All payments are subject to the following conditions:-

The description of services of matchmaking is specific to your need when you log in with your unique password. Normally payment is required in advance (i.e. before you commence your activity).

All Fees quoted are in Indian Rupees. The MyWealthJunction reserves the right to change the fees at any time.

  • Your payment will normally reach the MyWealthJunction account to which you are making a payment within two working days.
  • We cannot accept liability for a payment not reaching the correct MyWealthJunction account due to you quoting an incorrect account number or incorrect personal details. Neither can we accept liability if payment is refused or declined by the credit/debit card supplier for any reason?
  • If the card supplier declines payment the MyWealthJunction is under no obligation to bring this fact to your attention. You should check with your bank/credit/debit card supplier that payment has been deducted from your account.
  • In no event will the MyWealthJunction be liable for any damages whatsoever arising out of the use, inability to use, or the results of use of this site, any websites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.
Refund Policy
  • If the Customer leaves the MyWealthJunction before they complete their service period, there shall be no entitlement to a refund of paid service fees.
  • Refunds, if applicable, at the discretion of the Management, will only be made to the debit/credit card used for the original transaction. For the avoidance of doubt, nothing in this Policy shall require the MyWealthJunction to refund the Fees (or part thereof) unless such Fees (or part thereof) have previously been paid.
  • Any request about a refund should be mailed to support@mywealthjunction.com
  • www.mywealthjunction.com shall refund if you decide to cancel the subscription within 7 days of payment, you should not use our Financial Planning Software/Tool and send us an email at support@mywealthjunction.com However, if you use or commence data entry of any information or such attempt, no refund shall be made
Confidentiality

You shall keep confidential information received by MyWealthJunction according to this Agreement, even after termination of this Agreement. You agree to protect the proprietary information of MyWealthJunction to which you gain access to with the same standard of care and procedures used to protect your proprietary information of similar importance but at all times using a reasonable degree of care.

You agree not to use or disclose the information provided under the service to any third party including any discussion Forums or for any unauthorized illegal purpose or commercial usage. You also agree to use the information provided under the plan strictly for personal purpose. You should not decompile, disassemble, copy, modify, distribute, transmit, display, perform, reproduce, publish or create derivative works from, transfer, or sell any information, services etc accessed here. You agree that any unauthorized use of MyWealthJunction information or systems shall be unlawful and may subject to civil or criminal penalties.

Termination

You agree that MyWealthJunction,in its sole discretion, for any or no reason, and without penalty, may suspend or terminate your account (or any part thereof) or your use of the Website, at any time. MyWealthJunction may also in its sole discretion block, restrict, disable, suspend or terminate your access to the Website, or any part thereof, with or without notice. You agree that any termination of your access to the Website and or any account you may have or portion thereof may be effected without prior notice, and you agree that MyWealthJunction will not be liable to You or any third party for any such termination or interruption. Any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies MyWealthJunctionmay have at law or in equity. Upon termination for any reason, you agree to immediately stop using the Website / Service. The User may terminate his / her account with MyWealthJunction by raising a termination request in writing through email at support@mywealthjunction.com Such termination request can only be initiated when the portfolio value of the User is Zero, and (ii) there is no due payable to MyWealthJunction from the User.

Limitation of Liabilities

In no event, MyWealthJunction or its contractors, agents, licensors, directors, employees, associates, partners or suppliers will be liable to You for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages (including without limitation lost business opportunities, losses in investment products, lost revenues, or loss of anticipated profits or any other pecuniary or non-pecuniary loss or damage of any nature whatsoever) howsoever arising.

In no event, MyWealthJunction,directors, employees, agents will be liable to You or any third party for any damages, liabilities, losses, and causes of action arising out of or relating to (i) this Agreement; (ii) use of or access to the Website or any reference Site / App / Platform / Service; or (iii) Your use or inability to use the Services provided by MyWealthJunction (including all materials) or any reference Sites / App / Platform / Service; or (iv) any other interactions with MyWealthJunction, or (v) any action caused by AMC or RTA or any other third party, however, caused and whether arising in contract, tort including negligence, warranty or otherwise, beyond or over ₹500, or the amount required as per Regulatory guidelines, whichever is lesser.

You acknowledge and agree that MyWealthJunction has offered its Services, set its prices, and entered into this Agreement in reliance upon the warranty disclaimers and the limitations of liability set forth herein, that the warranty disclaimers and the limitations of liability set forth herein reflect a reasonable and fair allocation of risk between You and MyWealthJunction, and that the warranty disclaimers and the limitations of liability set forth herein form an essential basis of the bargain between You and MyWealthJunction. MyWealthJunction would not be able to provide the Services to you on an economically reasonable basis without these limitations. This paragraph shall survive the termination of this Agreement.

Indemnification

You agree to indemnify, save and hold MyWealthJunction/ the AMC / Mutual Fund, their affiliates, employees, officers, directors and partners harmless from all claims, losses, damages, and liabilities, costs and expenses, including without limitation legal fees and expenses, arising out of or related to (i) Your use or misuse of the Services / Website; (ii) any violation by You of this Agreement or applicable laws; or (iii) any breach of the representations, warranties, and covenants made by You herein; or (iv) any act, neglect, misconduct or fraud on your part; or (v) sharing and or disclosing the information disclosed hereunder. MyWealthJunction reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify MyWealthJunction, including rights to settle, and you agree to cooperate with MyWealthJunction’s defence and settlement of these claims.

MyWealthJunction will use reasonable efforts to notify You of any claim, action, or proceeding brought by a third party that is subject to the foregoing indemnification upon becoming aware of it. This paragraph shall survive termination of this Agreement.

Modification of Terms

MyWealthJunction reserves the rights to change, modify, add, or remove portions of this Agreement (each, a change and collectively, changes) at any time by posting a notification on the Website or otherwise communicating the notification to You. The changes will become effective, and shall be deemed accepted by You, 24 hours after the initial posting and shall apply immediately on a going-forward basis concerning Your use of the Website, availing the Services or for payment transactions initiated after the posting date. If You do not agree with any such change, Your sole and exclusive remedy are to terminate Your use of the Website / Service. For certain changes, MyWealthJunction may be required under applicable law to give You advance notice, and MyWealthJunction will comply with such requirements. Your continued use of the Website / Service following the posting of changes will mean that you accept and agree to the changes.

Notices

MyWealthJunction may provide you with notices and communications by e-mail, SMS, push notifications, regular mail or postings on the Website or by any other reasonable means. Except as otherwise set forth herein, notice to MyWealthJunction must be sent by courier or registered mail to [compliance@mywealthjunction.com]

MyWealthJunction shall send out all notices, information and other correspondence to you by email/SMS at the email address/telephone number provided by the User. In the event any notice, information or other correspondence is sent to you via letter, such letter will be sent to the postal address that you have given as your Communication address. In case of any change in your email id and/or mobile number / Correspondence address, you shall inform MyWealthJunction in advance in the prescribed format to carry out the necessary changes in its records.

MyWealthJunction does do not guarantee that electronic communications will be successfully delivered, or that they will be secure and virus free. MyWealthJunction will not be liable for any loss, damage, expense, harm or inconvenience caused as a result of an email being lost, delayed, intercepted, corrupted or otherwise altered or for failing to be delivered for any reason beyond our reasonable control. All correspondence will be in English.

You agree to be contacted by MyWealthJunction and its representatives over the phone or on registered email id concerning the Services. You agree & confirm that if your mobile number is registered in the Do Not Disturb (DND) list of TRAI, you may not receive SMS from MyWealthJunction. You agree to take steps to deregister from the DND list and shall not hold MyWealthJunction liable for non-receipt of SMS in the interim period.

Waiver

The failure of MyWealthJunction to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by MyWealthJunction.

Dispute Resolution

If any dispute, controversy or claim arises under this Agreement or concerning the Website / Service, including any question regarding the existence, validity or termination of this Agreement or any specific terms contained herein (hereinafter Dispute), the parties shall use all reasonable endeavours to resolve such Dispute amicably. If the parties are unable to resolve the Dispute amicably within 30 days of the notice of such Dispute, MyWealthJunction may elect to resolve any Dispute by binding arbitration by the provisions of the Indian Arbitration & Conciliation Act, 1996 (hereinafter Act). Such Dispute shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The Dispute shall be resolved by a sole arbitrator, appointed by MyWealthJunction on behalf of both the Parties by the Act. The seat of the arbitration shall be Bengaluru and the language of this arbitration shall be English. Either You or MyWealthJunction may seek any interim or preliminary relief from a court of competent jurisdiction necessary to protect the rights or the property belonging to You or MyWealthJunction (or any of our agents, suppliers, and subcontractors), pending the completion of arbitration. Any arbitration shall be confidential, and neither You nor MyWealthJunction may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcing the arbitration award. All administrative fees and expenses of arbitration will be divided equally between You and MyWealthJunction. In all arbitrations, each party will bear the expense of its lawyers and preparation. This paragraph shall survive termination of this Agreement.

Governing Laws

Subject to the Dispute Resolution section above, you agree that any claim or dispute you may have against MyWealthJunction must be resolved by a court having jurisdiction in Bengaluru, India. You agree to submit to the personal jurisdiction of the courts located within Bengaluru, India, to litigating all such claims or disputes. This Agreement shall be governed by Indian law. This paragraph shall survive termination of this Agreement.

Severability

If any provision of this Agreement is held to be unlawful, void, invalid or otherwise unenforceable, then that provision will be limited or eliminated from this Agreement to the minimum extent required, and the remaining provisions will remain valid and enforceable.

Survival

Upon termination of this Agreement, any provision, which, by its nature or express terms should survive, will survive such termination or expiration as applied to transfers and relationship before such termination or expiration.

Headings

The heading references herein are for convenience purposes only and they do not constitute a part of these T&Cs and will not be deemed to limit or affect any of the provisions hereof.

Entire Agreement

These terms and conditions are the entire agreement between you and MyWealthJunction relating to the subject matter hereof and this Agreement will not be modified except by a change to this Agreement made by MyWealthJunction in accordance with the terms of this Agreement.

Force Majeure

If the whole or any part of the performance of the respective obligations of the parties hereunder is prevented or delayed by reasons of natural calamities, war, arson, civil disturbance, unavailability of any communication system including Internet, breach or virus in the processes or payment mechanism, sabotage, acts of government, computer hacking, unauthorized access to computer data and storage devices, computer crashes, breach of security and encryption codes and such other reasons beyond the reasonable control of a person (each a “Force Majeure Event”), then to the extent either party shall be prevented or delayed from performing all or any part of their respective obligations under this Agreement despite due diligence and reasonable efforts to do so, then such party shall be excused from performance hereunder for so long as reasons of Force Majeure Event continue. A Force Majeure Event shall not affect the payment obligations of the parties unless there is a legal bar/embargo to the making of the payments.

Assignment

The right to use the Website / Service is personal to you and is not transferable by assignment, sublicense, or any other method to any other person or entity.
